Form 5743 Current Year Sales

Beginning with 2021 foreclosure sales and transfers, a person that intends to make a claim for excess sales proceeds must complete and return this notarized notice to the Foreclosing Governmental Unit by July 1 in the year of foreclosure. This notice must be delivered via certified mail, return receipt requested, or by personal service. Completing and returning this form evidences an intent to make a future claim but is not itself a claim for sales proceed

Form 5743 - Current Year Foreclosure Sales Claims

Motion to Claim Remaining Proceeds must file this form with the circuit court clerk at the Saint Clair County Circuit Court, 201 McMorran Boulevard, Port Huron, MI, 48060. The motion must satisfy the requirements of MCL 211.78t(4) and must be filed between February 1, 2025 and May 15, 2025. Form CC 540 - Motion to Claim Remaining Proceeds

St Clair County is participating in a settlement of claims for surplus proceeds from tax foreclosure auctions before 2021. The settlement is for properties that were sold for more than the outstanding taxes and expenses between 2013 and 2020. Class members are persons or entities that had an ownership interest in the property. The case is Fox, et al. v. Saginaw, County, et al. Case No. 1:19-cv-11887, pending in the United States District Court for the Eastern District of Michigan. More information is available at the official website for this settlement, which can be found at the link below. Class members should have received a notice of this settlement in the mail. If you think you are entitled to participate in the settlement and have not received a notice you can contact the claims administrator through the website. You must timely file a claim to participate in the settlement. The claims deadline is July 16, 2026.
